Referred to hereinafter as “Twleef” or “the Platform”
1. Definitions
For the purposes of this document, the following words and phrases shall have the meanings assigned to each of them, unless the context requires otherwise:
- Platform / Service: Refers to Twleef platform, a digital Software as a Service (SaaS) platform that relies on AI technologies to generate and optimize advertising and commercial content, including but not limited to: images, videos, designs, texts, or any other digital outputs.
- User / Subscriber: Any natural or legal person who creates an account and uses the platform, whether free or paid.
- Subscription: The paid plan that grants the user access to the features and services of the platform according to the specified duration and packages.
- Credits: Virtual digital units used within the platform to generate content or use certain services.
- Content: All data or materials uploaded or entered by the user into the platform, including images, logos, texts, trademarks, or any other files.
2. Acceptance of Terms
By using the Twleef platform, creating an account, or subscribing to any of its services, you expressly acknowledge and agree to fully comply with these Terms and Conditions, and any other relevant policies published on the platform. If you do not agree to these terms, you must immediately stop using the platform.
3. Scope of License and Use
- Twleef platform grants you a limited, non-exclusive, non-transferable, and non-sellable license to use the platform solely for legitimate commercial or personal purposes according to your subscribed plan.
- The user is prohibited from: • Copying, reproducing, decompiling, or reverse engineering the platform or any part thereof. • Reselling, sharing, renting, or making the service available to a third party without prior written consent from Twleef. • Using the platform for any illegal purpose or one that violates the laws in force in the Kingdom of Saudi Arabia or any other jurisdiction. • Using the platform to create content that violates public morals, intellectual property rights, privacy rights, or the rights of others.
4. Accounts and Liability
- The user bears full responsibility for the accuracy of the data provided when creating the account.
- The user is fully responsible for maintaining the confidentiality of their login credentials and for any activity that occurs under their account.
- Twleef reserves the right to suspend or terminate any account proven to be used in violation of these terms without prior notice.
5. Subscriptions, Payment, and Billing
- Subscription prices and packages are clearly displayed within the platform and may be modified from time to time.
- Subscriptions renew automatically unless canceled by the user before the renewal date.
- All fees paid are non-refundable, unless explicitly stated otherwise in a separate policy.
- In the event of payment failure or delay, the platform reserves the right to suspend or restrict access to the service until payment is completed.
6. Intellectual Property
- All intellectual property rights related to the platform, including software, algorithms, models, designs, trademarks, and trade names, remain the exclusive property of Twleef platform or its licensed partners.
- The user retains all intellectual property rights to the content they upload, but grants Twleef a non-exclusive, global, royalty-free license to use this content solely for the purpose of providing, operating, and improving the service.
- Twleef bears no responsibility for any infringement resulting from the content uploaded by the user.
7. Disclaimer
- The platform is provided “as is” and “as available” without any express or implied warranties.
- Twleef does not guarantee that the service will be error-free or available without interruption.
- Twleef bears no responsibility for: • Loss of profits or data. • Any indirect or consequential damages resulting from the use or inability to use the platform. • The results of advertising campaigns or commercial performance resulting from the use of AI outputs.
8. External Services and Links
The platform may integrate with third-party services or tools. Twleef bears no responsibility for the content, performance, or policies of these external parties.
9. Termination of Use
- The user has the right to cancel their subscription at any time according to the cancellation mechanism available in their account.
- Twleef reserves the right to terminate or suspend access to the platform immediately in the event of a violation of the terms.
- Termination does not entail any obligation to refund paid fees.
10. Amendments to Terms
Twleef platform reserves the right to amend these terms at any time. Continued use of the platform after the publication of amendments constitutes explicit consent thereto.
11. Governing Law and Jurisdiction
These terms are governed by and construed in accordance with the laws and regulations of the Kingdom of Saudi Arabia, and the exclusive jurisdiction shall lie with the competent courts within the Kingdom.
